We make reasonable efforts to keep website information accurate, but we do not guarantee that pricing, availability, hours, parking spaces, or services listed on the website are always current.

4. Parking Is a License Only

Use of the garage creates a limited license to park a vehicle in an available or assigned space, subject to these Terms and any posted rules. Parking at Central Huntington Garage does not create a lease, tenancy, storage agreement, bailment, or transfer of possession of the vehicle or its contents.

You remain responsible for your vehicle and all personal property inside it at all times.


5. No Bailment or Custody of Vehicle

Central Huntington Garage does not take custody, control, or possession of any vehicle or personal property. The garage provides a location to park, but we are not a bailee, insurer, or guarantor of the vehicle or its contents.

Parking in the garage is at the vehicle owner’s and driver’s own risk.


6. Parking Availability

Parking spaces are subject to availability unless a specific written reserved parking agreement states otherwise. We do not guarantee that a particular space, floor, entrance, exit, or area of the garage will always be available.

Garage access may be affected by maintenance, repairs, weather, events, construction, emergencies, equipment failure, law enforcement activity, utility issues, or other circumstances outside our control.


7. Rates, Fees, and Payments

Parking rates, fees, and payment terms may vary based on parking type, duration, location, reserved status, monthly agreement, or special event pricing.

By making a payment, you agree to pay the amount charged for the selected parking service. Payments may be processed online or through third-party payment providers. We do not store full credit card or debit card information on our website servers.

Unless otherwise stated in writing, parking payments are final and non-refundable once parking access, reservation, or parking rights have been provided.


8. Monthly Parking

If monthly parking is offered, monthly parking customers are responsible for paying all charges by the due date stated in the applicable invoice, account portal, or written agreement.

Monthly parking does not guarantee ownership of any parking space unless a written reserved-space agreement specifically states otherwise. Failure to pay may result in suspension of access, cancellation of parking privileges, late fees, towing, or other enforcement action.

Monthly parking terms, cancellation requirements, access methods, and rates may be updated from time to time.


9. Non-Dispute / Chargeback Waiver

By submitting payment for parking services, you agree not to initiate a chargeback, payment dispute, or payment reversal through your bank, credit card company, or payment provider unless the transaction was unauthorized or fraudulent.

All billing concerns must first be brought directly to Central Huntington Garage by emailing centralhuntingtongarage@outlook.com or calling 304-617-2946.

If a chargeback or payment dispute is submitted after parking access, parking rights, or parking services have been provided, we reserve the right to pursue recovery of the disputed amount, administrative costs, chargeback fees, collection costs, court costs, and legal fees to the fullest extent permitted by law.


10. Customer Responsibilities

All customers, visitors, and drivers are responsible for:

  • Parking only in authorized spaces 
  • Following posted signs and garage rules 
  • Paying all required parking fees 
  • Locking vehicles and securing valuables 
  • Maintaining vehicle insurance 
  • Driving safely and cautiously inside the garage 
  • Observing speed limits, directional signs, and pedestrian areas 
  • Keeping access credentials, passes, tickets, or codes secure 
  • Removing vehicles before any applicable expiration time 
  • Ensuring the vehicle does not leak fluids, create hazards, or block access 

Customers may not damage, misuse, alter, obstruct, or interfere with the garage, parking equipment, cameras, access systems, signs, doors, gates, payment equipment, lighting, elevators, stairwells, or other property.


11. Prohibited Uses

The garage may not be used for:

  • Vehicle repair or maintenance, unless expressly authorized 
  • Storage of abandoned, disabled, unregistered, or inoperable vehicles 
  • Overnight occupancy, sleeping, camping, or living inside a vehicle 
  • Storage of hazardous, flammable, illegal, or explosive materials 
  • Blocking drive lanes, exits, entrances, stairwells, elevators, or access points 
  • Commercial activity without written permission 
  • Loitering, dumping, vandalism, trespassing, or illegal conduct 
  • Any activity that creates a safety risk or violates law 

Violation of these Terms may result in removal from the property, suspension of parking privileges, towing, booting, reporting to law enforcement, or other legal action.


12. Towing, Booting, Removal, and Enforcement

Vehicles may be towed, booted, relocated, or otherwise removed at the owner’s expense if they are:

  • Parked without payment or authorization 
  • Parked in a reserved, restricted, blocked, or unauthorized area 
  • Abandoned, disabled, leaking fluids, or creating a hazard 
  • Blocking entrances, exits, lanes, other vehicles, equipment, or emergency access 
  • In violation of posted signs, garage rules, or these Terms 
  • Associated with unpaid balances, improper chargebacks, or misuse of access credentials 

We are not responsible for towing charges, storage fees, damages, or other costs imposed by third-party towing or enforcement providers, except where required by law.


13. Security Cameras and Monitoring

Central Huntington Garage may use cameras, access logs, license plate records, or other monitoring systems for safety, security, operational, and enforcement purposes.

Security cameras and access systems are intended to assist with monitoring and deterrence. They do not guarantee prevention of theft, vandalism, damage, unauthorized access, or personal injury.

By entering or using the garage, you acknowledge that you, your vehicle, license plate, and activity may be recorded.


14. Damage, Theft, and Personal Property

Central Huntington Garage is not responsible for loss, theft, vandalism, collision, fire, water damage, weather-related damage, falling debris, mechanical issues, or damage caused by other customers or third parties.

Customers should not leave valuables inside vehicles. Any personal property left in a vehicle is left at the customer’s own risk.

Customers are responsible for maintaining appropriate vehicle insurance and any other coverage they deem necessary.


15. Accidents and Incident Reporting

Any accident, injury, property damage, theft, or security concern should be reported promptly to Central Huntington Garage and, where appropriate, law enforcement.

Reporting an incident does not create an admission of liability by Central Huntington Garage. We may review available information, camera footage, account records, or access logs at our discretion, subject to privacy, legal, and operational limitations.


16. Access Credentials, Passes, and Codes

If a customer is issued an access card, pass, ticket, code, permit, or other credential, the customer is responsible for keeping it secure. Access credentials may not be shared, sold, copied, transferred, or misused without written permission.

Lost, stolen, shared, or misused credentials may result in replacement fees, account suspension, cancellation of parking rights, or additional charges.


17. Communications Consent

By submitting your phone number, email address, contact form, parking inquiry, or account information, you consent to be contacted by Central Huntington Garage regarding parking availability, customer service, billing, account matters, garage access, updates, and related business communications.

Communications may occur by phone, email, text message, or other available methods. Message and data rates may apply for text messages. You may opt out of promotional communications, but we may still contact you regarding active parking accounts, payments, access, safety, or legal matters.


18. Intellectual Property

All website content, including text, photos, graphics, logos, branding, layout, design, and other materials, is owned by or licensed to Central Huntington Garage. You may not copy, reproduce, modify, distribute, or use website content for commercial purposes without written permission.
